Policy for Commercial Use of Library-Produced Electronic Information
This policy covers all electronic documents or electronic-based
information produced by, or with value added by, UCB Library staff on
Library time that are published by the Library on its network servers. All
such items are under copyright by the UC Regents, and copyright is
expressly retained unless altered by written agreement with the University
of California. Different ways of stating this fact are included below for
attachment to electronic documents.
In specific cases, Library administration, acting as agents of the UC
Regents, may allow limited use of Library produced documents by commercial
organizations. The general outlines of these cases are provided below, but
each request must follow the procedure outlined in this document.
General Guidelines for Acceptable Commercial Use
These are some general guidelines on the kind of situations in which
permission is most likely to be granted to allow a commercial service to
provide access to information provided by the UCB Library:
- Individuals accessing the Library's document(s) via the commercial
service are not assessed a charge specifically for such access (that is,
the commercial service does not collect a fee for each use of that
document)
- The Library should receive adequate compensation. Compensation can vary
from recognition of our contribution (minimum) to monetary payment.
Procedure for Obtaining Permission for Use by a
Commercial Organization
- Submit a request for permission to the Library
Web Services Manager, with a copy of the document(s) in question, or
with (preferred) the Uniform Resource Locator (URL) for the item(s).
Include in the request the commercial organization involved, the use to
which they wish to put the document(s), and any offered compensation for
the use of the material.
- If the request meets the guidelines specified above in all cases, the
request will most likely be granted without further review.
- If the request does not meet the guidelines in some aspect, the request
may require discussion with Library administration.
- Following appropriate review, the request will either be approved or
denied, with the reason(s) specified.
- A denied request may be resubmitted if it is changed to more closely meet
the guidelines outlined above.
- A denied request may be appealed by submitting the information specified
in 1) above, the statement of denial, and your reasons for appealing to
Bernie Hurley (bhurley@library).

Documents
Below are some suggested methods of attaching a copyright statement
to electronic documents produced by UCB Library staff.
