In regard to "accepted practice," what would be the definition of that
term? Accepted by the Department of Justice as an defensible
interpretation of copyright law? Just because a practice is common
(i.e. copying an lp to a cd format without attempting to get permission
from the copyright holder) doesn't mean it's legal.

My understanding is that when you buy a program, you have a right to it
for the life of the tape, not in perpetuity. However if you have made an
honest effort to find a replacement or get permission to make a
replacement copy but can't locate the copyright holder, then it is okay
to make a copy.
