This was a really fun doc. Most of the conversations we have about Fair Us=
e on this listserv are pretty specific to how it should apply in a "legitim=
ate" teaching context, but this film was much more about transformative use=
and the creation of new creative works by taking from existing works - mos=
tly amateur, not for profit works (i.e. remixed YouTube content). The high=
er profile legal cases here seem much more likely to shape law and preceden=
t than University X putting a 20 minute clip in Blackboard, so it's worth t=
aking note.
I think the biggest issue that could be taken with the film is how rights h=
olders were portrayed - you are all big and bad. And there was an interview=
scene with a woman at the US Copyright office that kind of made my heart h=
urt. But at the same time, it gave a really good overview of how copyright =
law has changed over time to favor the rights holder (especially with the S=
onny Bono Act and the DMCA) and how this conflicts with the way a lot of =
people are making creative works (quoting audio and visual works, instead o=
f print).
Really interesting film, definitely worth watching. Would create a whole ne=
w fisticuffs inducing listserv thread!
