I believe that if you reproduce the image from an original 1866 cover of
Harper's Weekly it is in PD because it was published before 1923.

Unrelated to video, but I have no one else to ask:

I’m searching for a professor to get permission
for to use, or is this public domain, the Jan. 6,
1866, cover of Harper’s Weekly * titled, “The Last Chattel”.

Also looking for copyright information on images
associated with this image -- a horrible
exhibition race titled, "What is It: Or man Monkey"
