INTELECOM is a non-profit producer of distance learning courseware that is
designed for delivery on computer networks as well as for traditional
broadcast, cablecast, DVD, CD, mobile devices, etc. Below you will find our
position statement re the TEACH Act. In short, the fact that we develop and
market content PRIMARILY for mediated instructional activities utilizing
digital delivery methods and networks (among other technologies) means our
content is excluded from the scope of TEACH Act.
Our two cents on the subject. Actually, a great deal more than two cents.we

This notice is to explain our position on the Technology, Education and
Copyright Harmonization Act of 2002 (TEACH Act).
Important Caution
INTELECOM's course materials are produced and marketed "primarily for
performance or display as part of mediated instructional activities
transmitted via digital networks." For that reason, it is the position of
INTELECOM that INTELECOM course materials fall outside the scope of the
TEACH Act and may NOT be used except pursuant to a valid license from
INTELECOM.
Background on the TEACH Act
Section 110(2) of the Copyright Act, Title 17 United States Code, was
amended in 2002 to provide for certain permitted uses of copyrighted
material under the so-called TEACH Act (Technology, Education and Copyright
Harmonization Act of 2002). Under certain specific and narrow circumstances,
some kinds of copyrighted materials may be digitally delivered for distance
learning without permission of the copyright owner.
Works Specifically Excluded From the Scope of the TEACH Act
Several categories of copyrighted work are specifically excluded from the
scope of the TEACH Act, including works that are "produced or marketed
primarily for performance or display as part of mediated instructional
activities transmitted via digital networks," a category that applies to the
course materials of INTELECOM. Accordingly, it is the position of INTELECOM
that its course materials fall outside the scope of the TEACH Act and may
not be used without a valid license from INTELECOM.

All,
I would be interested in hearing from those who have studied the issue as to
why (and how) TEACH would or would not apply in this situation. It seems
that everyone has a very different understanding of what this portion of the
law allows and getting all the different opinions (hopefully supported by
the text of the law or accompanying documents or the published work of
copyright specialists or lawyers) could be valuable for us as video
librarians.

Professor V. regularly teaches a semester-long class to approximately 150
students. 8 videos from a variety of distributors (NOT feature films) are
screened in full, face-to-face, during regularly scheduled class times.
Could rights be obtained to stream the entire 8 films on the class website
every time the course is offered? Could rights be obtained on a
semester-to-semester basis? The course management system would only permit
registered students to view the films-who presumably already saw the entire
film during their class but need to review for papers/tests. If possible,
how much time and cost do you estimate in obtaining these rights? Or-would
you just go ahead and not clear rights in this case?

the entire film during their class but need to review for papers/tests.
If possible, how much time and cost do you estimate in obtaining =

rights? Or—would you just go ahead and not clear rights in =
this
