I would think that it is trademarked, but I do not think that it is
copyrighted or the old max Fleischer's cartoons would technically not be
in the public domain. Wasn't that how they pulled It's a Wonderful Life
out of the public domain because there were copyrightable aspects in the
movie. If Superman is copyrighted, then a movie about him would also
then by default be copyrighted. Just my two cents. YMMV.

We had a patron ask this question today: is the Superman image
copyrighted? I thought I'd ask this list as you all are knowledgeable
about these issues.
