[Videolib] Weirdest form YET

Ok guys I just got the STRANGEST "form" I have EVER scene regarding
media "rights" from a University. Frankly I am NOT even sure what it is
asking for but it states that the University in question owns one of our
titles and wishes to inform us that the film will be made available to
all "authorized " users unless we object. It explains these are students &
faculty etc. Said Library is part of a larger University library system and
all branches & members of system are supposedly included in this "agreement"
It than goes on to state that teaching is "conducted.... interactively via
the web and media including distance learning program. We have
collaborative arrangements with industry, community groups, and non- profit
organizations". It also makes reference to databases on CD-ROM by site
license agreements. I am TOTALLY at a lose here.
I don't know if they are asking or telling me they intend to put our film
out on their distance learning & web sites and allow community groups to use
it. This is one of those forms which I find NUTS way beyond the text because
it ASSUMES rights which at least if I am reading it right it does not have
and than says it will do these things UNLESS we object. In this particular
case they actually GOT the correct rights holder but as you know the vast
majority of feature films ( as this was) are NOT in fact licensed by company
than distributes it so in theory hundreds and thousands of these forms
are going out to companies that have NOTHING but home video rights to the
titles in question.
>From my point of view EITHER you are using the media within norms of
copyright ( Face to Face teaching) or you had better be damn sure
you find company WITH broadcast & PPR rights if you need them and GET
A CONTRACT.
There were other very strange things in this document but the main thing is
the very idea that anyone would send a form for something AFTER they bought
it ( hey I don't like them before much either) for rights not included in
face to face use.
