As DAN CARNEVALE notes:
"One of the law's most problematic requirements is that
instructors make "reasonable" efforts to prevent students'
disseminating the audio or video clips to others. Although the
music-sharing software company Napster has been put out of
business, second-generation peer-to-peer networks like KaZaA
allow people to make digital copies of popular songs and
movies without paying a cent to the copyright owners. Those
networks are wildly popular among college students."

I just wanted to call to your attention that the newest version of our
Media Library Software from Niche Solutions, called MediaTrak, actually
prevents the "further downstream copying" of a digitized title. Each title
is Encrypted and the customized viewer included with the package, utilizes
a "Key" that validates the file before it can be viewed. The teacher must
have a reservation before the viewer allows play of the file. The Media
Center keeps control of the copyrighted video wares, even when downloaded
to the teachers computer. You may find that it is the only product
currently on the market that provides the Library Reservation Software, Web
Presence, AND the Controlled Digital Delivery of your product.

I asked for the development of the product in direct response to the TEACH
Act and Copyright Law. I felt we needed a complete package, capable of
encompassing ALL of the issues involved with the Digital Delivery of
Copyrighted materials, as well as the needs of a Regional Media Center.
